European Data Protection Supervisor
Kurzportrait der Organisation
Der Europäische Datenschutzbeauftragte (EDSB), auf englisch kurz EDPS (European Data Protection Supervisor), ist eine unabhängige Datenschutzbehörde der Europäischen Union (EU). Er überwacht die Organe, Einrichtungen und sonstige Stellen der EU soweit sie personenbezogene Daten von natürlichen, lebenden Personen verarbeiten. Der EDPS gewährleistet das Grundrecht auf Schutz personenbezogener Daten (Art. 8 EU Grundrechte Charta) sowie den Schutz der Privatspähre (Art. 7 EU Grundrechte Charta).
Die Aufgaben und Befugnisse des EDPS sind nicht in der DSGVO, sondern in Art. 52 ff. einer separaten Datenschutzverordnung der EU (EU 2018/1725) festgelegt. Er oder sie wird vom Europäischen Parlament und dem Rat im gegenseitigen Einvernehmen für eine Amtszeit von fünf Jahren gewählt. Das Amt ist öffentlich auszuschreiben und die Liste der Bewerbungen mit mindestens drei Bewerber*innen ist von der Kommission öffentlich bekannt zu geben. Die Anforderungen der Bewerbung sind in Art. 53 der Verordnung geregelt.
Der EDPS veröffentlicht als unabhängiges Kompetenzzentrum Stellungnahmen und Leitlinien.
Der Sitz des EDPS ist Brüssel.
